Applying is a request for review. Your accepted written service agreement defines the season, scope, payment schedule and service commitments. Your statutory rights always remain.

Eastern Snow and these terms
These terms govern use of Eastern Snow’s website and client portal and explain the residential application process. The public website provides information and an application tool for St. John’s, Mount Pearl, Torbay, Paradise and Conception Bay South. An address in one of these municipalities is not, by itself, a promise that a particular property or route has capacity.
Contact Eastern Snow at 709 986 5702. For personal-information requests, ask for the person responsible for privacy. For written service notices, use the supplier contact details on your quote or service agreement. Please do not send passwords, full card numbers, or unnecessary sensitive information.
Any service agreement must identify the contracting supplier and its business/contact details. These website terms do not replace those disclosures or the signed service agreement.

Calculations, applications and confirmation
Provide accurate information and have authority to request work at the property. The calculator displays a price based on your selected driveway capacity and add-ons, with HST and your chosen number of payments. Review the selections and total before applying. An application does not reserve a route, confirm service, take payment or itself form a season-pass service contract.
Eastern Snow reviews the property and availability and may request clarification, decline an application or propose corrected terms. We do not silently change an agreed total. Any difference from a calculator result must be explained and accepted before a service contract is made. A quote’s validity period and acceptance requirements are those shown on the quote.
Service activation is confirmed by Eastern Snow after the applicable agreement and payment requirements are met. A typed signature on an issued quote records the agreement described on that screen; it does not prove that payment has been received. Do not treat a quote, an application reference or an unpaid invoice as a payment receipt.

Your service agreement comes first
Before accepting a service agreement, review the property, season start/end dates, exact areas to be cleared, snowfall trigger (if any), service timing, included return visits, excluded work, total price, taxes, payment dates and cancellation/refund terms. You must have an opportunity to correct errors, accept or decline, and retain a copy. Ask for clarification if any required detail is missing.
The specifically accepted service agreement prevails over general website descriptions for that service, subject to mandatory law. These terms do not add undisclosed charges, take away promised work or rewrite an existing contract. Marketing statements are not a substitute for complete service details.

Prices, instalments and receipts
Amounts are in Canadian dollars. Applicable HST is itemised; the calculator currently uses Newfoundland and Labrador’s 15% rate. The accepted invoice and agreement identify the amount due and any schedule of up to six instalments. Choosing instalments divides payments according to that schedule; it does not automatically reduce the agreed total.
Pay only using verified instructions issued by Eastern Snow. Placeholder payment addresses, demonstration records and disabled checkout options are not instructions to send money. We do not currently complete online Stripe payments on the quote page. No additional interest, late fee, return-payment fee, collection fee or automatic renewal is imposed by these website terms; any lawful charge or renewal arrangement must be clearly disclosed and accepted separately.
Payments, receipts and remaining balances appear after Eastern Snow records received funds. Contact us about an error; a delay in recording a payment does not erase proof that it was received. Any service suspension for non-payment must follow the accepted agreement, notice requirements and applicable law.

Snow service and property access
Only the areas and work specified in your accepted agreement are included. Walkway shovelling is included only when agreed. Salting, de-icing, roof work, hauling snow away, steps, public sidewalks, municipal plow berms and extra return visits are not automatically included by a general website description; check the agreement for the treatment of each item.
Provide safe access and accurate instructions about gates, parked vehicles, shared access, surface conditions and hazards. Mark vulnerable objects and obstacles such as drains, uneven surfaces, edging and utility fixtures. Do not provide access codes through public social-media comments. If safe access is unavailable, the crew may be unable to complete the visit; the agreement and applicable law determine rescheduling and any consequences. Sharing access instructions authorises only access reasonably needed for agreed service.
Snow clearing does not guarantee a bare, ice-free or slip-free surface. Snow and ice can remain or return, including after a municipal plow passes. Continue using reasonable winter safety precautions. This description does not excuse careless work or remove obligations under the service agreement or law.

Weather, timing and Crew arrival
Weather, road conditions, earlier jobs, route changes, equipment issues and unsafe conditions can affect timing. Crew arrival is a periodically refreshed estimate from route progress, not live vehicle GPS and not a guaranteed appointment. Scheduled, waiting, delayed, reached, cleared and cancelled labels report operational status; a “cleared” label is not a guarantee that a surface is free from every hazard.
Check official warnings and take appropriate precautions. Eastern Snow may pause unsafe work and communicate or reschedule as reasonably possible under the agreement. An interruption outside our reasonable control does not remove mandatory rights or automatically permit us to retain payment for work we owe but do not provide.

Cancellation, refunds and issues
Contact Eastern Snow promptly to request a cancellation or report a service/payment problem. Include your name, property and relevant reference; retain a copy of your notice and evidence of when it was sent. A preview-only issue form is not a working notice channel: use the published telephone number and the contact details in your service agreement.
Contract-specific cancellation and refund arrangements must be disclosed before acceptance and cannot reduce mandatory consumer rights. There is no blanket “all sales final” rule in these website terms. Any lawful charge for work already supplied must follow the agreement and law; no cancellation penalty is created here.
Newfoundland and Labrador’s Consumer Protection and Business Practices Act provides cancellation remedies for qualifying distance sales, including failures to provide required disclosures, a compliant contract copy, or timely delivery. Where a contract is cancelled under section 32, section 33 requires the supplier to refund the money without deduction within 15 days after notice. Direct-sales rules may provide additional cancellation rights when applicable. The legislation determines eligibility and timelines; nothing here limits them.
Report suspected damage as soon as reasonably possible, with photographs if appropriate, and avoid altering evidence except to make an area safe. Prompt reporting helps investigation; this request is not a shortened legal claim deadline. The website is not an emergency service—use emergency services when needed.

Accounts, security and acceptable use
Portal registration is limited to email addresses on Eastern Snow’s client records. Account creation may require staff activation before documents become available. Use only your own authorised account, keep your password/private document links secure and notify us of suspected misuse. Do not assume possession of someone’s email address gives authority to access their records.
Do not impersonate others, submit fraudulent requests, interfere with the site, bypass access controls, scrape private records or upload harmful or unlawful material. We may restrict access for a legitimate security, misuse or legal reason, while preserving applicable rights and obligations. A portal restriction does not itself cancel a paid service contract. You remain able to request your records and raise a billing or privacy concern through our contact channel.

Content, external links and site availability
Eastern Snow branding and original site content may not be copied or used to suggest affiliation without permission. You may save and print your own agreements, invoices, receipts and these policies. Third-party material retains its own licence terms; address data is adapted from Statistics Canada’s National Address Register.
External services, including social media and future payment providers, have their own terms and privacy practices. We do not control their availability. We aim to keep our information and systems accurate and available but cannot promise uninterrupted or error-free website operation. Contact us to correct an error rather than relying on a broken page or an apparent technical mistake.

Responsibility, disputes and your rights
To the extent permitted by law, Eastern Snow is not responsible for indirect losses caused solely by a website outage or reliance on a route estimate, rather than a breach of an obligation owed to you. This limited website statement does not exclude responsibility that cannot lawfully be excluded, bodily injury, fraud, wilful misconduct, our negligence, privacy obligations or promised service. It does not create a cap on a property-damage claim or require you to indemnify us for our own acts.
Contact us so that we can try to resolve a concern. These terms do not require mandatory arbitration, waive class proceedings, prevent complaints to regulators or replace access to a competent court. Newfoundland and Labrador law and applicable federal Canadian law govern, subject to any mandatory protections and jurisdiction rights that apply to you. If a provision cannot be enforced, the remaining provisions apply only so far as consistent with those protections.

We publish revised website terms with their effective date for future use and applications. Material changes will receive additional notice when required. Posting an update does not retrospectively change an accepted service contract or authorise a materially new use of personal information. Keep a copy of the version relevant to your transaction.
